Terms and Conditions of Sale

Effective as of October 10, 2025.

These General Terms and Conditions of Sale have been translated into several languages to facilitate reading and understanding. However, in the event of any discrepancy in interpretation or contradiction between a translated version and the original French version, only the French version shall be deemed authentic and legally binding.

1. ACCEPTANCE OF THE TERMS AND CONDITIONS

These general terms and conditions define the rights and obligations of the parties in the context of the sale of products offered by Provencelia.

The Customer acknowledges having read and unreservedly accepted these general terms and conditions of sale when validating their order. These GTC shall prevail over any other document, except in the case of an express written exemption.

The general terms and conditions of sale may be updated at any time.The applicable Terms and Conditions of Sale for an order are those in effect on the date of said order.

2. SCOPE OF THE OFFER

The Provencelia sales offer is available in all countries and regions where delivery is offered at the time the order is confirmed

3.PRODUCT INFORMATION AND LIMITATION OF LIABILITY

Provencelia is committed to providing accurate and up-to-date information about its products. However, minor errors may occur.

All products presented are described through a product sheet and accompanied by one or more non-contractual photos. The characteristics of the products are described as faithfully as possible. The advice is given for information purposes only and in no way engages the responsibility of Provencelia in the event of failure to achieve the expected results.

Provencelia cannot be held responsible for site interruptions or delays due to maintenance, technical failures, or force majeure.

4. PRODUCT AVAILABILITY

Our products are available while stocks last.In the event of unavailability after the validation of an order, Provencelia undertakes to inform the Client as soon as possible and to offer either:

  • A replacement with an equivalent item.
  • A refund within 30 days.

5. PLACING AND VALIDATION OF THE ORDER

  • Any order validated by the Client constitutes a firm and definitive commitment.
  • A confirmation email is sent after the order is validated.
  • Provencelia reserves the right to cancel any order for legitimate reasons (fraud, obvious error, out of stock, payment issue).

6. PRICE AND PAYMENT

  • The prices displayed are in euros (€) and include the applicable VAT.
  • Delivery charges are specified before the order is validated.
  • Payments are secure and can be made by:
    • Credit card (Visa, Mastercard, American Express)
    • PayPal
    • Payment in installments via Alma
    • Instant or bank transfer

Retention of title clause: The products remain the property of Provencelia until full payment is received in accordance with the provisions of law no. 80-335 of May 12, 1980.

In the event of non-payment, Provencelia reserves the right to reclaim the delivered products. In this situation, and upon first request from Provencelia, the Client undertakes to immediately return any unpaid product, at their own expense.

The seller will be entitled to cancel the sale if the displayed price is too low compared to the purchase price due to a pricing display error.

7. DELIVERY

7.1.Delivery Conditions

The products ordered are delivered to the address indicated by the Customer at the time of ordering, subject to accessibility. It is the Customer's responsibility to verify the accuracy and completeness of the information provided.

In the event of an error, omission, or incomplete address, Provencelia cannot be held responsible for the inability to deliver within the initially scheduled timeframes.

It is specified that carriers charge Provencelia fees for each unsuccessful delivery attempt, as well as for any address modification once the shipment has been initiated. Consequently, additional charges may be billed to the Customer in these situations, particularly in the case of inaccessible delivery locations, re-presentation of the package, or address changes after shipment.

Delivery day:

  • Products packaged on pallet(s) are delivered to the doorstep for houses and to the building entrance for apartments.
  • The carrier is not authorized to unpack or install the products.
  • In the case of delivery requiring specific conditions (upper floor, difficult access, pedestrian street, need for a crane truck, etc.), an additional charge will apply.
  • Deliveries are made from Monday to Friday, excluding public holidays. No specific time commitment can be guaranteed.

Delivery is deemed to have taken place as soon as the product is handed over to the carrier. The delivery note signed by the Customer serves as proof of transport and delivery.

7.2. Receipt of the order

Upon receipt of the products, the Customer is responsible for checking the condition of the goods.

Important:

  • Do not sign the delivery note without having checked the integrity of the packages.
  • Take the time to inspect the products without giving in to pressure from the delivery personnel.
  • In case of breakage or damage, precise and detailed reservations must be noted on the transport document and confirmed within 72 hours with photos, via registered letter with acknowledgment of receipt to the carrier, with a copy sent to Provencelia.

Attention: General statements such as "subject to unpacking" or "subject to verification" are not valid for insurance purposes and will not be taken into account.

If the delivery person refuses to assist with unpacking, it is imperative to indicate this on the delivery note: " The delivery person refused to assist with the unpacking of the product.»

The Client acknowledges that the absence of a written reservation on the delivery note is equivalent to acceptance of the products in conformity, except in the case of the application of the legal guarantee of conformity.

7.3. Delivery time

Delivery times are governed by articles L.216-1 to L.216-3 of the Consumer Code. Provencelia undertakes to deliver the product on the date or within the period announced to the Client.

7.4. Transfer of risk

The risk of loss or damage to the goods is transferred to the Client as soon as they take possession of the products.

If the Client chooses a carrier other than the one proposed by Provencelia, Provencelia's responsibility ends as soon as the products are handed over to the carrier chosen by the Client.

7.5.Refund conditions in case of late delivery

If Provencelia does not meet the delivery deadline, the Customer may request:

  • An exchange for a product that can be delivered more quickly.
  • A credit note for a future purchase.
  • A full refund within 30 days, excluding company closure periods.

8. RIGHT OF WITHDRAWAL AND RETURN OF PRODUCTS

8.1.  Right of withdrawal

In the event of delivery not conforming to the order or a defective item, the seller undertakes to take back the product or offer an exchange. Non-conformity must be established, if necessary, by our quality department, based on the elements provided by the customer (photos, description, etc.).

Furthermore, the consumer has a period of 14 days from receipt of the goods to exercise their right of withdrawal.In the event of exercising the right of withdrawal, the item must be returned no later than 14 days after notification of the decision.

The consumer must return it in its original packaging, indicating the reason for refusal on the delivery note or invoice, and may request:

  • A new delivery in accordance with the initial order, if non-conformity is proven.
  • Cancellation of the order (with reimbursement of the amounts paid or a credit to be used on a future order).

Return costs are the responsibility of the consumer, unless the delivered product is defective or does not conform to the order.

The following are also the responsibility of the consumer:

  • Any additional delivery costs if a more expensive delivery method was chosen than the one usually offered by the seller.
  • The fixed and proportional costs of the service provision, the execution of which began before the end of the withdrawal period, at the express request of the consumer.

For service provisions, if the consumer expressly requests that the execution of the service begins before the end of the withdrawal period, they will not be liable for any fees if the professional has not collected this request on a durable medium (paper, email, time-stamped form) or has not clearly informed them of their obligation to pay an amount proportional to the service already provided in the event of withdrawal.

Note: The e-merchant must provide the legal guarantee of conformity, which allows the consumer to choose between exchange and repair in the event of a manufacturing defect or breakdown of a new product, for a period of 2 years. The professional is required to respond to this request within a maximum period of one month.

Exceptions to the right of withdrawal:

  • Customized products or products made to order.
  • Products returned incomplete or damaged by the Customer.

8.1.  Take-back of used products under the "1 for 1" scheme

In accordance with current regulations, Provencelia offers the take-back of a used product when purchasing an equivalent new product ("1 for 1" take-back). This take-back is subject to the following conditions:

  • The product to be taken back must be of equivalent size, nature, and function to the one purchased,
  • The customer must provide proof of purchase,
  • The transport of the product to be taken back is at the customer's expense,
  • The take-back is carried out at the place of delivery or at a collection point defined by Provencelia.

To arrange a return, the customer is invited to contact our customer service.

9. LEGAL WARRANTY OF CONFORMITY

All products benefit from the legal warranty of conformity and the warranty against hidden defects. Any claim must be made within 2 years following receipt of the product.

If you notice a defect more than 2 years after delivery, you can no longer benefit from the legal warranty of conformity.

Some of our pottery is made from glazed clay and, as such, is subject to frost damage. This natural phenomenon is easily identifiable and cannot be contested. Only our quality department is authorized to confirm a possible defect. To preserve their integrity, our pottery must be stored in a frost-free place before the first frosts.Climatic variations, especially alternating rain and frost, can cause successive expansions of the material, thereby altering the structure of the pottery. Pottery left outside during the winter may begin to deteriorate without immediate visible signs and may crumble the following year.

As clay is a porous and living material, we cannot guarantee a precise resistance threshold to temperatures. Since each piece of pottery is unique, two items made and fired under the same conditions may react differently. Furthermore, clay is sensitive to chemicals, aggressive fertilizers, and hard water, which can lead to the appearance of efflorescence. This phenomenon, resulting from the rise of salts contained in the clay or soil, causes crazing of the pottery. This alteration is in no way due to a manufacturing defect but rather to unsuitable maintenance conditions, and therefore is not covered by our warranty.

As our pottery is designed to promote plant growth, its structure remains breathable, including the glazed saucers. It is recommended to protect the floor by raising the saucer using suitable supports (plastic-coated, carpet, cork) to avoid any direct contact. Additionally, to prevent falls due to bad weather, we advise weighting the pottery or placing it in a sheltered area away from strong winds. All our pottery has drainage holes to ensure proper drainage; therefore, it is essential to provide a saucer or a water collector.

Failure to comply with these maintenance instructions will automatically exclude the product from the legal conformity warranty. This warranty does not cover defects found upon receipt. Our products are carefully packaged and shipped in excellent condition, but incidents may occur during transport.It is therefore mandatory to check the condition of the products at the time of delivery, by opening the package and inspecting each product (absence of cracks, chips, or breakage). Any claim regarding damage occurring during transport must be made immediately.

The following are excluded from the legal warranty of conformity:

  • Frozen pottery.
  • Pottery showing efflorescence or crazing.
  • Pottery that has stained a floor.
  • Pottery broken or overturned due to weather conditions.
  • Pottery that is downgraded or end-of-line, offered at a reduced price due to defects mentioned at the time of purchase.

As our pottery is handcrafted, certain characteristics cannot be considered as non-conformities.This includes variations in dimensions (± 7%) and shapes due to manual turning methods, enamel drips resulting from our dipping technique, differences in shades depending on the application of colors or the position of the pieces in the kiln. Similarly, the diameter of the drainage hole may be irregular and slightly off-center due to manual production.

The thickness of the enamel may sometimes partially cover it, but this does not constitute a defect. For any specific order or custom-made production, no claim under the legal guarantee of conformity will be accepted.

10.     PHOTOGRAPHS AND VISUAL REPRESENTATIONS

The visuals presented on this site, including photographs, staged images, retouched images, or those generated using digital techniques or artificial intelligence, are provided for illustrative purposes only. They are intended to suggest an atmosphere or a possible setting and are not contractually binding.

These representations do not constitute a commitment by the seller regarding the exact appearance of the delivered product. Differences may exist in terms of shade, proportions, texture, or final rendering, particularly due to the artisanal nature of the manufacturing process, lighting conditions during photography, or the display settings of each screen.

11.FORCE MAJEURE

In the event of force majeure (strikes, natural disasters, pandemic), Provencelia cannot be held responsible for delays or cancellations.

12. PERSONAL DATA AND LEGAL INFORMATION

The personal data and information collected for the purpose of distance selling are mandatory, as this information is essential for processing and delivering orders, and issuing invoices. Failure to provide this information will result in the order not being validated.

By placing an order on the Provencelia website, the customer also agrees that their personal data may be used by Provencelia for information and commercial promotion purposes regarding the products and services offered by the brand. Provencelia undertakes to process personal data in accordance with the General Data Protection Regulation (GDPR).

The customer may, at any time, choose to stop receiving these communications by clicking on the unsubscribe link present in each message or by directly contacting customer service.

For more information on the management of personal data and user rights, the customer is invited to consult the Privacy Policy available on the website.

13. USE FOR COMMERCIAL REFERENCING PURPOSES

Unless expressly stated otherwise in writing by the professional Client before order confirmation, the latter authorizes Provencelia to use its company name, name, logo and, where applicable, its brand, as a commercial reference on its communication materials (website, social networks, presentation documents, etc.).

The Client may at any time express their objection to this use by submitting a written request to the following address: contact@provencelia.com.

14. TESTIMONIALS, REVIEWS AND SUGGESTIONS

Any review, suggestion, testimonial, creative idea, project or content submitted to Provencelia, whether at our request or spontaneously—whether sent by email, via a form, a message, or any other channel—may be freely used by Provencelia for communication, promotion, or improvement of its products or services.

By submitting such content, the Client grants Provencelia a non-exclusive, royalty-free, worldwide, and perpetual license to use, reproduce, modify, publish, translate, distribute, and display this content in any media. This use will not entitle the Client to any compensation.

The customer undertakes not to transmit any content& :

  • of a defamatory, insulting, obscene, violent, or discriminatory nature& ;
  • contrary to the legislation in force, public order, or good morals& ;
  • infringing the rights of third parties, in particular with regard to intellectual property, confidentiality, privacy, or image rights.

The Customer guarantees that they hold all necessary rights to the content they provide to Provencelia and that none of this content infringes the rights of any third party.

Provencelia reserves the right (without being obliged to do so) to monitor, moderate, or delete any content submitted by a Client if it contravenes the above commitments, or if Provencelia deems it illegal, harmful, offensive, threatening, defamatory, obscene, contrary to public order or good morals, in violation of intellectual property rights, or more generally incompatible with these Terms of Use. This intervention may take place at any time and without prior notice.

15. APPLICABLE LAW & DISPUTES

These general terms and conditions of sale are governed by French law.

In case of any difficulty encountered during the ordering or delivery of our products, the Client may contact our Customer Service at the following address: contact@provencelia.com.

Any complaint will be carefully reviewed and Provencelia will strive to find an amicable solution with the Client.

In the event of a persistent disagreement, any dispute relating to the interpretation or execution of these general terms and conditions of sale shall be subject to the exclusive jurisdiction of the French courts.

This contract is governed by French law, both for substantive and procedural rules.

Failing an amicable resolution, the courts within the jurisdiction of Provencelia's registered office shall have authority to settle the dispute.

16. INTELLECTUAL PROPERTY

All content on the site (texts, photos, logos) is protected by copyright. Any reproduction without authorization is prohibited.

17.

VALIDITY OF THE GENERAL TERMS AND CONDITIONS

If any provision of these general terms and conditions of sale is declared null and void in whole or in part, the other provisions and the other rights and obligations arising from these general terms and conditions of sale shall remain unchanged and shall continue to apply.

18. ELECTRONIC VALIDATION

The validation click of an order constitutes an electronic signature with the same legal value as a handwritten signature.
